Due diligence is defined as "the level of judgment, care, prudence, determination, and activity that a person would reasonably be expected to take under particular circumstances". The "due diligence" concept is directly reflected in Ontario's environmental, health and safety (EHS) legislation: both the Occupational Health and Safety Act and the Environmental Protection Act place specific legal and personal duties on key personnel in a workplace to prevent breaches of compliance.
